I'm wondering about creating a YouTube channel.

I have several questions, but the main one is:

Can I download a clip that is already on YT? It shows me playing and I'd like to include it. Does the fact that someone else (presumably the person who filmed it) having put it on YT mean that it's copyrighted and therefore unavailable?

If they posted it without your permission, I'd say you have the copywrite claim. But the best way is to just message the person who's youtube channel it is and tell them what you want to do. what youtube channel is it?

I've studied copyright law, and you really don't have any case. If someone else films you and posts it online, they own "implied Copyright" to the video, and they have no legal rights unless they register it with the Federal Copyright Office and pay the fees. No court will hear the case if not registered. If they get compensation for it, you might be able to get a case that they should have gotten a clearance from you to post it. But the media situation these days is such that many , many things get posted without clearance from the person being filmed. Just look at all the podcasts these days. It's pretty doubtful that they are getting clearance from their subjects before posting. If that was the case, people getting bashed online would refuse clearance and they couldn't post it.

By the way, I have a YouTube channel with videos of me that I have downloaded, and have had no backlash.

Occasionally YouTube has given me a copyright ding ... in fact the last video I posted, (And I Love Her) got a ding. BUT, the ding amounted to nothing, the ding still allowed it to be posted without any restrictions. I did the playing, and I made the track.

Roger it may not be ideal, but you could link to the site your video is one. There are programs that allow you to get the audio off of the video, such as MediaHuman. There may be a way to "snag" the actual video, but that I don't know how to do.

I've gotten many 'copyright warnings' on YouTube. Basically, they are warning you that you can't monetize the video without getting copyright clearance from the rightful owner of the copyright for the song. That would be illegal pursuant to copyright laws.
